  • Wyo. Stat. § 35-7-1002 – Definitions.
  • Wyo. Stat. § 35-7-1056 – Delivery of, or possession with intent to deliver, drug paraphernalia.
  • Wyo. Stat. § 35-7-1057 – Delivery of drug paraphernalia to a minor.
  • NOTE: Wyoming does not criminalize the use or possession with intent to use drug paraphernalia. Further, unlike in most states, the definition of “drug paraphernalia” under Wyoming law does not include “testing,” “analyzing,” or similar terms. Wyoming explicitly criminalizes the act of giving away drug paraphernalia. There are increased penalties for delivering drug paraphernalia to a minor. While Wyoming’s definition of drug paraphernalia does not explicitly include drug checking equipment, it does include “all equipment, products and materials of any kind when used, advertised for use, intended for use or designed for use for manufacturing, converting, preparing, packaging, repackaging, storing, containing, concealing, injecting, ingesting, inhaling or otherwise introducing into the human body a controlled substance in violation of this act.” There is no case law on the application of this definition to drug checking equipment.
